Hunt's comments read as if they were scripted by James Dalton from the ABI. To echo an earlier comment, if a firm is considered to be unscrupulous, they should be identified with particulars of the unscrupulous behaviour being provided and raised with the regulator. If they are genuinely acting in an unscrupulous manner, then they will be sanctioned. Presumably such unscrupulous behaviour will be relevant to conduct, so can be raised before the trial / costs Judge. I think it is also fair to require that allegations of unscrupulous behaviour are no just thrown at all "law firms". Do they mean solicitors? CMCs? Barristers? or all of the above?

The consultation paper highlights an increasing amount being paid out in respect of Claimant costs. There has been no recent development that would result in Claimant solicitors receiving more costs for the same types of case. It can only be assumed that more cases are being concluded successfully in the face of denials of breach and causation.
