No firm decides to use an unrated insurer purely because it's unrated. The choice of insurer is illusory, more often that not,, and the firm is often offered only one insurer's cover. I'd recommend a single profession-wide policy, saving inordinate amounts of time scouring the brokers who advertise such wonderful service but often cannot locate any wiling insurer at all or- occasionally- no more than one. The single profession-wide policy would be underwritten by all existing insurers dividing-up the market in whatever proportions they wish. Yes, solicitors who have a poor claims record should face an extra premium. Those with clean records should correspondingly receive a No Claims Discount; why is this available in just about every other insurance field except ours?
