Still on the topic of delays, Obiter has been keeping an eye on the omnivorous mega trial – in all aspects, think claimants, legal teams, damages, listing time – in Municipio de Mariana, Rodovia Juscelino Kubitschek and others v BHP Group Ltd and another before Mrs Justice O’Farrell.
So far, all seems to be going reasonably smoothly – but the 12-week hearing has already left behind its planned timetable. BHP’s first factual witness, Christopher Campbell, was expected to finish giving evidence by Tuesday but instead finished on Wednesday.
Contingencies have been built in and a little tardiness is to be expected in a case such as this; but there’s a lot to get through before closing submissions, which are expected to start at the end of – cripes – February 2025.
