On 12 May Jonathan Rayner reported on the ‘outcry’ that has arisen because in-house lawyers might be prevented from working pro bono.

In addressing this issue, two principles should be kept in balance:Isn’t the simplest solution to require SRA approval, even if in a modified form from that required for other solicitors in practice?

  • The public should be protected and the reputation of solicitors maintained by recognisable and effective oversight, such as that exercised by the SRA for other solicitors in practice. The employer of an in-house solicitor may be happy with their services, but presumably if they are to be included in new pro bono arrangements they may be doing the work for members of the public outside their employer;
  • Solicitors willing and able to provide pro bono work should be encouraged.
