I am writing in respect of new public guardian Martin John’s announcement of a review of the lasting power of attorney form (see [2008] Gazette, 7 August, 3). Key stakeholder organisations are already working together in preparation for this review and the wider review of the Mental Capacity Act.

Solicitors for the Elderly is working with Age Concern (England) and Help the Aged to ensure a coordinated approach. We are also working closely with the Law Society’s Wills and Equity Committee and the Society for Trust and Estate Practitioners.

Solicitors for the Elderly has raised concerns about both the forms, and practice and procedure issues, with the Office of the Public Guardian and others since October 2007. Any review would be meaningless without active participation and the adoption by those in authority of a willingness both to listen and to effect the necessary change. We have no reason to doubt that we are at the start of a more positive era in this regard.
