I note that one of the changes to the Legal Ombudsman scheme rules is to accept complaints from prospective clients who could reasonably have expected to receive a service.

This appears to be inconsistent with the principles of risk management in Lexcel, whereby the risk manager is encouraged not to accept instructions from clients when it is perceived that the client presents a risk of complaint or litigation.

I am representing a client who is currently on police bail, but have made the decision not to represent her during the court proceedings if she is charged, because she is a complaint risk. No doubt I can now fall foul of the new scheme rules?
