I read with interest Karen Jackson’s article on sexual harassment and the legal profession.
I am militantly against harassment, discrimination, antisemitism and so on. But I am also for justice. What about where allegations are simply made up? That does happen. We all know the old adage that ‘litigation is a horse race’ and one reason that defendant companies settle some cases is that they don’t like the odds and place a higher value on protecting their reputation. And if such a ban on confidentiality in agreements were even possible, it might actually harm claimants. If there is absolutely no guarantee that your reputation won’t be dragged through the mud, why pay through the nose as well?
